The Ongoing Impact of the Treaty of Fort Laramie One notable treaty with lasting consequences is the Treaty of Fort Laramie, signed in 1868. According to this treaty, the United States pledged to designate the Great Sioux [Lakota] Reservation, including the Black Hills, for the "absolute and undisturbed use and occupation" of the Lakota Nation. Although neither party fully honored the terms of the treaty, the discovery of gold in the Black Hills motivated the United States to attempt buying back the land. However, the Lakota Nation rejected the offer, leading to the Black Hills War (1876-1877), famously known for Custer's Last Stand at the Battle of Little Bighorn.
Regrettably, in 1877, Congress reneged on the original treaty and passed an act reclaiming the Black Hills. Subsequently, in 1923, the Lakota Nation sued the government. After six decades, the Supreme Court recognized the annulment as a violation of the Fifth Amendment and deemed the tribe deserving of "just compensation" plus interest, retroactively calculated from 1877. Remarkably, the Lakota Nation has remained steadfast in their pursuit of justice, refusing the payment offered and persistently seeking the return of their ancestral land. As of 2018, the outstanding amount owed was estimated to be around $1 billion, representing a profound quest for restoration and sovereignty.
Removal and Resettlement: A Painful Chapter During the early 19th century, the policy of removal and resettlement dominated the federal government's approach to Native American tribes. The passage of the Removal Act in 1830 authorized President Andrew Jackson to negotiate for the removal and resettlement of various tribes, particularly the Cherokee, Creek, Choctaw, Chickasaw, and Seminole from states such as Georgia, Alabama, Mississippi, and Florida. Although removal was intended to be voluntary, it ultimately resulted in forced migrations and the infamous Trail of Tears.
Allotment and Assimilation: Shaping Native American Lands Throughout much of the mid-19th century, the U.S. government pursued a policy of "allotment and assimilation." Through treaties, often imposed upon tribes, common reservation lands were divided and allotted to individual families.
